WELCOME TO THE WEBSITE OPERATED BY SECURING SAFE FOOD CORP. (“SSF”).
BY USING OR VISITING THIS WEBSITE, YOU SIGNIFY YOUR AGREEMENT TO (1) THE TERMS OF
USE EXPRESSED ON THIS WEBPAGE and (2) ALL OTHER TERMS REFERENCED HEREIN.
Your use of SSF’s website (https://www.securingsafefood.org/) (the “Site”) including, without
limitation, all content, information, text, graphics, images, tools, and software programs
contained in the Sites and related materials, is governed by these terms and conditions of use
(“Terms of Use”).

SSF is a nonprofit corporation organized and operated exclusively for charitable and
educational purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code.
SSF is dedicated to fighting food insecurity among individuals with food allergies and
improving access to allergen-free foods. SSF is not a medical organization and does not
provide any medical guidance or advice meant to independently diagnose, treat, or prevent
any condition or disease, or to determine the status of your health. You acknowledge that
you will not provide any health or personal medical information in your outreach to SSF at
any of the forms on its Site, including, but not limited to, the “Contact Us” and “Make an
Impact” open response forms.

By visiting and using the Site, you acknowledge that you have read the Terms of Use and that
you accept and agree, without limitation or qualification, to be bound by the terms hereof. SSF
reserves the right, at its sole discretion, to change these Terms of Use at any time. When we do,
we will revise the “Last Updated” legend at the top of the page. Unless otherwise stated, the
then-current version of these Terms of Use will apply to your access and use of the Site after
the effective date of such changes. Your continued access to and use of the Site will be deemed
to be your acceptance of and agreement to any such changed terms and conditions. If you do
not wish to be bound to these Terms of Use (or any revisions to these Terms of Use), your only
resolution is to discontinue use of the Site.

Your use of the Site is also governed by our Privacy Policy, which is incorporated herein by

the right, and you authorize us, to use and assign all information provided by or collected from
you in any manner consistent with our Privacy Policy.

SITE CONTENT
The Site is provided on an “as is” basis and may use internet services that are not under our
direct control. While we strive to provide accurate descriptions in the Site content, we do not
warrant, and make no commitments that the descriptions or other content on the Site are
accurate, complete, or current. We do not warrant that the Site or its features will be accessible
at all times or that it will function in an error free manner. We reserve the right to cease
operating the Site or any of its features at any time.

names, service marks, logos, information obtained from SSF’s licensors, and other files or
information (“Content”), and the selection and arrangement thereof, is proprietary property
and protected by copyright, trademark, and other intellectual property laws under both United
States and foreign laws. Any use of Content not expressly permitted by these Terms of Use is a
breach of these Terms of Use and may violate copyright, trademark, and other laws.
SSF hereby authorizes you to view Content for non-commercial personal use only. You shall not
record or otherwise copy any Content. All rights not expressly granted herein are reserved to
SSF and its licensors.

Except as expressly provided above, you may not otherwise copy, display, download, distribute,
modify, post, reproduce, republish or retransmit any Content contained in the Site or any
portion thereof in any electronic medium or in hard copy, or create any derivative work based
on such Content, without the express written consent of SSF. No information or statement

contained in these Terms of Use or the Sites shall be construed as conferring, directly or by
implication, estoppel, or otherwise, any license or right under any patent, copyright, trademark
or other intellectual property right of SSF, its affiliates, or any third party.
You may not, without SSF’s written permission, “mirror” any Content contained in the Site or
any other server. You may not use the Site for any purpose that is unlawful or prohibited by
these Terms of Use. You may not use the Site in any manner that could damage, disable,
overburden, or impair the Site, or interfere with any other party’s use and enjoyment of the
Site.

SUBMISSION OF INFORMATION BY USERS VIA SSF’S OPEN RESPONSE FORMS
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or
other information about the site or the service (“Submissions”), provided by you to
SSF—including, but not limited to, the “Contact Us” and “Make an Impact” open response
forms available on the Site—are non-confidential and SSF may use such Submissions in
furtherance of its charitable mission, including for educational, research, or advocacy purposes,
without acknowledgement or compensation to you.

You represent, warrant and agree that no Submissions of any kind submitted by you through
the Site violates, or infringes upon the rights of any third party, including copyright, trademark,
privacy, publicity or other personal or proprietary rights, or contains libelous, defamatory, or
otherwise unlawful material.

You represent, warrant, and agree not to submit any personally identifiable information,
including any Submissions containing personally identifiable information, about any person who
is under 18 years of age.

Further, you represent, warrant, and agree not to submit any health or personal medical
information in your Submission(s) to SSF.

THIRD PARTY CONTENT
This Site may provide content from, or links or references to, other sites. SSF is not responsible
for information, products or services obtained on such other sites and is not liable for any
damages arising from access to such Sites. Any links to other sites are provided merely as a
convenience to the visitors of this Site and any inclusion of such links in this Site does not imply
an endorsement or warranty of the linked sites or their content, products or services. The
Terms of Use stated in this policy apply only to this Site. Visitors to this Site are cautioned that
linked sites are governed by their own use and privacy policies, so visitors linking to such sites
should make sure to visit the appropriate pages of those sites to determine what policies will

apply. SSF reserves the right to remove any link or linking program from this Site, at any time,

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Content shall create any warranty, representation or guarantee not expressly stated in these
Terms of Use. SSF makes no warranty or representation that availability or use of the Sites or
Services will be uninterrupted or error-free.

Limitation of Liability
UNDER NO CIRCUMSTANCES WILL SSF BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT,
INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS,
LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY
LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR
THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL
SSF’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED
ONE HUNDRED DOLLARS ($100). YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE
AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.

You may have additional rights under certain laws (including consumer laws) which do not
allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. If
these laws apply to you, the exclusions or limitations in this Agreement that directly conflict
with such laws may not apply to you.

APPLICABLE LAW AND JURISDICTION
These Terms of Use and any dispute arising under or related to these Terms of Use (whether for
breach of contract, tortious conduct or otherwise) will be governed and construed in
accordance with the laws of the State of Connecticut, without regard to principles of conflict of
laws. You consent to the exclusive jurisdiction of the state and federal courts located in the
State of Connecticut for any action arising out of or relating to these Terms of Use, and you
waive any objection to venue in such courts. You acknowledge that monetary damages for
improper use of this Site or other breach of these Terms of Use may be inadequate. Therefore,
SSF is entitled to seek equitable relief in any court in the State of Connecticut, including
injunctive relief against you, in addition to all other remedies.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless SSF from any liability, loss, claim and
expense (including attorneys’ reasonable fees) arising directly from (i) your material violation of
these Terms of Use, and (ii) your misuse of the Site in a manner not authorized by these Terms
of Use.

WAIVER AND SEVERABILITY
No waiver by SSF of any term or condition set out in these Terms of Use shall be deemed a
further or continuing waiver of such term or condition or a waiver of any other term or
condition, and any failure of SSF to assert a right or provision under these Terms of Use shall
not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent
jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be
eliminated or limited to the minimum extent such that the remaining provisions of the Terms of
Use will continue in full force and effect.

ENTIRE AGREEMENT
These Terms of Use constitute the sole agreement between you and SSF relating to your use
and our provision of the Site and the subject matter hereof.
